French court finds Pharma negligent in diabetes drug controversy

11/23/2015 // JusticeNewsFlash // (press release)

France – A French court has deemed a pharmaceutical company negligent years after controversy began over a diabetes drug linked to the deaths of hundreds of patients. AFP reported that the court in the Paris suburb of Nanterre found Servier to have been negligent in having left medicine that is “defective” on the market.

The scandal broke in 2007 after a doctor, Irene Frachon, brought the heart risks associated with the Mediator drug to widespread attention. The drug was intended to be prescribed as for individuals who are overweight with diabetes; however, it has widely been prescribed as an appetite suppressant.

Two patients filed lawsuits against the company seeking 900,000 and 125,000 euros ($1 million and $140,000) in damages; however, they were awarded a fraction of what they were seeking by the court.

Charles Joseph-Oudin, an attorney for one of the victims, has said that his client would appeal the size of the award.
